Acceptable Use Policy (AUP)

All IP Users (“Users” or “Lessees”) of IP ADDRESS MARKET must agree to this policy, in addition to our Terms of Service.

Heficed’s Acceptable Use Policy (“AUP”) is provided to give our users a clear understanding of what Heficed expects of them while using the service.

This document is intended to provide a basic understanding of Heficed’s AUP. The following are guidelines for the establishment and enforcement of Heficed’s AUP:

  • Ensure reliable service to our users
  • Ensure security and privacy of our systems and network, as well as the networks and systems of others
  • Comply with existing laws
  • Maintain Heficed’s reputation as a responsible service provider
  • Encourage responsible use of the Internet and discourage activities which reduce the usability and value
  • Preserve the privacy and security of individual users
  • Maintain Lessors IP address reputation

Violations of Heficed’s Acceptable Use Policy

The following Types of Abuse constitute violations of this AUP:

  1. Copyright infringement;
  2. Malware/Phishing;
  3. SPAM;
  4. Unacceptable/Illegal materials;
  5. Other: Anything else that doesn’t fall under any of the categories below.

Reporting Abuse

If any activity is deemed worthy reporting to the Heficed Abuse Desk, there are two ways to do this:

  1. By creating a ticket from Terminal (Abuse Management);
  2. By using Heficed’s contact form https://www.heficed.com/report-abuse;

If available, the following information should be provided:

  • The IP address (obligatory) and domain (if available) used to commit the alleged violation
  • The date and time of the alleged violation, including the time zone or offset from GMT
  • Any available evidence of the alleged violation: email headers, logs (plain text where possible), screenshots, etc.

Lack of adequate evidence will result in Heficed’s inability to resolve the issue. The Abuse Desk language is English.

Heficed does not actively monitor subscriber activity under normal circumstances. Similarly, Heficed does not exercise editorial control over the content of any website, e-mail transmission, newsgroups, or other material created or accessible over or through the services.

However, in accordance with Heficed’s TOS (Terms of Service), any materials that, in Heficed’s sole discretion, may be illegal, may subject Heficed to liability, or which may violate this AUP can be removed.

Law enforcement:

Heficed may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrongdoing. A user’s violation of this AUP may result in the suspension or immediate termination of either user’s Heficed account or other actions.

Should Heficed receive a take-down request from the trusted hotlines – Heficed will proceed with an immediate take-down.

If a Heficed’s account is used to violate the Acceptable Use Policy or Heficed’s TOS, Heficed reserves the right to terminate the User’s service without notice. Heficed prefers to advise users of inappropriate behavior and any necessary corrective action; however, flagrant violations of the Acceptable Use Policy will result in immediate termination of service. Heficed’s failure to enforce this policy, for whatever reason, shall not be construed as a waiver of Heficed’s right to do so at any time.

Expected handling timelines:

Heficed expects Users to react to abuse reports immediately, and will follow up if no action is taken. Failing to receive any response within a given timeline, the services might be subject to suspension until further notice or terminated based on the severity of the issue.

Spam, Spamvertisement, Malware – 24h.

Copyright infringement, Phishing – 48h.

Any other types of abuse – up to 48h.

Handling of the issue might take longer over the weekend and bank holidays.

IMPORTANT NOTICE:

Anyone hosting web sites or services on their server, that support spammers or cause any of 3rd party’s  IP space (which is available on Heficed IP Address Market) to be listed in any of the various Spam Databases or blacklists will have their Lease immediately suspended.

Upon the occurrence of an Abuse and at any time thereafter, Heficed may exercise from time to time any one or more of the following remedies:

(a) terminate the Lease as to any portion or all of the IP Numbers leased;

(b) use, lease or otherwise dispose of any or all of the IP Numbers leased in such manner as Heficed in its sole discretion may decide;

(c) accelerate the due date of all remaining Lease payments due hereunder for the entire remaining Initial Period of the Lease;

(d) recover the sum of: (i) any accrued and unpaid fees, plus (ii) the present value of all future fees reserved in this Lease and contracted to be paid over the unexpired Initial Period of the Lease (or any renewal period then in effect); plus (iii) all costs and expenses incurred by Heficed in any repossession, recovery, re-lease or other disposition of the IP Numbers, including but not limited to costs of administration, advertising and broker’s fees together with all attorney’s fees and cost incurred in connection therewith or otherwise resulting from IP User’s default (including any incurred at trial, on appeal or any other proceeding) (h) exercise any other remedy permitted by law.

The Lease will not be reconnected until such time that you agree to remove ANY and ALL traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been COMPLETELY removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the User.

Revisions to This Acceptable Use Policy

Heficed reserves the right to revise, amend, or modify this AUP and our other policies and agreements at any time and in any manner.
